$435,000 Recovery for Client Injured in Rear-End Crash

In 2010, we were contacted by a Cobb County woman who had been involved in a car crash involving her Honda Odyssey van and a tow truck. The 51-year-old woman was stopped in the left turn lane at the intersection of Peachtree Dunwoody Road and Hammond Drive. Unfortunately, the tow truck driver failed to stop and collided with the rear of our client’s van.

Immediately following the accident, our client began experiencing neck and back pain accompanied by neurological symptoms including pain and numbness in her left leg and foot. She underwent multiple treatments, MRIs, a lumbar laminotomy and discectomy in an effort to relief the pain and injuries that she sustained. The medical expenses incurred by the victim exceeded $100,000, which left her in an ominous state.

In the state of Georgia, drivers are required to maintain a proper lookout for known and reasonably foreseeable automobiles and exercise ordinary care to avoid injuring other motorists. In this instance, the tow truck driver failed to comply with these regulations, so Attorneys Andrew Jones and Chase Swanson were able to prove his liability in the crash. The purpose of the legal claim brought by the victim was to obtain financial compensation for her suffrage. In addition to incurring extensive medical expenses and painful injuries, she also missed work, and therefore missed an opportunity to earn a living. She will continue to be plagued with medical costs and pain and suffering as a result of the rear-end crash.

Fortunately, Jones & Swanson was able to resolve her claim for $435,000, an amount acceptable to the victim. She will be able to use this compensation to pay medical expenses and to make up for the loss of wages that she experienced as a result of the incident. We are hopeful that all future expenses that she experiences as a result of the injuries she sustained will be covered in the recovered amount as well.
